Huzz AI Terms of Service

Acceptance of Terms

By downloading or using Huzz AI (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Huzz AI (referred to as "we", "us", or "our"). If you do not agree to any part of these Terms, you must not use the App. You must also comply with all applicable laws and the Apple App Store rules when using the App.

Eligibility and License to Use

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Huzz AI. We grant you a personal, limited, non-transferable, non-exclusive license to install and use the App on an Apple device that you own or control, for personal and non-commercial use only. This license is provided solely to allow you to use and enjoy the App's features as intended by us, in accordance with these Terms. We reserve all rights not expressly granted to you. You agree not to redistribute or make the App available on any unauthorized platform.

Accounts and Registration

In order to access certain features, you may need to create an account within the App. You agree to provide accurate, current, and complete information during registration and to keep your login credentials secure. You are responsible for all activities that occur under your account. If you believe your account has been compromised, contact us immediately. You are responsible for ensuring that your use of the App does not violate any applicable laws or regulations.

Subscription and Payment

Huzz AI is free to download, but full access requires a paid subscription available exclusively through Apple's App Store in-app purchases. We offer a one-time 3-day free trial period for new subscribers. After the 3-day free trial ends, your chosen subscription plan will automatically begin and your Apple App Store account will be charged. You must cancel at least 24 hours before the end of the free trial to avoid being charged for the subscription.

Auto-Renewal: All subscriptions automatically renew on their billing cycle (e.g., weekly, monthly, or annually) unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
Managing Subscriptions: You can manage and cancel your subscription at any time via your Apple ID account settings. It is your responsibility to manage your subscription and cancellations through the App Store.
No Refunds: All subscription charges are final. Because we offer a free trial to evaluate the App, we do not provide refunds or credits for any subscription fees once charged, including for partially used periods. If you cancel your subscription, you will retain access to premium features until the end of the paid period, but no pro-rated refunds will be given for the remaining time.
Payment Processing: All payments are handled by Apple via the App Store. We do not collect or store your payment card details. Please refer to Apple's payment terms for additional information. We are not responsible for any errors or issues arising from Apple's payment processing, but we will make reasonable efforts to support you in resolving them.

Permitted Use and Restrictions

You agree to use Huzz AI only for lawful purposes and in accordance with these Terms. You must not:

Reverse Engineering: Copy, modify, adapt, disassemble, decompile, or reverse engineer any part of the App or its software.
Unauthorized Access: Attempt to gain unauthorized access to the App, other users' accounts, or our systems, or interfere with the proper working of the App (for example, by introducing viruses or harmful code).
Prohibited Content: Use the App to transmit or store any content that is unlawful, defamatory, harassing, threatening, or otherwise objectionable. This includes using the App in any manner that could harm minors or violate anyone's rights.
Commercial Exploitation: Sell, resell, or exploit the App or its content for any commercial purpose without our prior written consent.
Violation of Laws or Rights: Use the App in any way that violates any applicable law, regulation, or the rights of others (including intellectual property rights and privacy rights).

We reserve the right to investigate and take appropriate action (including suspension or termination of your access) if you engage in any of the above prohibited activities or any other behavior that we deem abusive or harmful.

Intellectual Property

All content and materials available on Huzz AI, including but not limited to text, graphics, logos, designs, software code, and the AI-generated responses or outputs ("Content"), are owned by us or our licensors and are protected by intellectual property laws. We retain all rights, title, and interest in and to the App and Content. You may not use our trademarks, brand names, or logos without our prior written permission.

Subject to these Terms, you are permitted to use the Content generated by the App for your personal use. However, you understand that the Content provided by the AI is for informational and entertainment purposes and may not be accurate, reliable, or suited for professional advice. You agree not to remove, obscure, or alter any copyright, trademark, or other proprietary rights notices that may be affixed to the App or Content.

If you choose to provide feedback, suggestions, or ideas to us regarding the App ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate your Feedback into Huzz AI or our other products without any obligation to compensate you.

Disclaimer of AI Advice

Huzz AI may provide answers, advice, or information through its artificial intelligence features. You acknowledge that any content or advice provided by the App is not professional, medical, legal, or financial advice. The information and responses are generated by an AI and are intended for general informational or entertainment purposes. They may not be accurate, complete, or applicable to your specific situation. You should not rely solely on Huzz AI for making important decisions. Always exercise your own judgment and, if needed, seek advice from a qualified professional.

We do not warrant or guarantee the correctness or reliability of any AI-generated results or recommendations. Your use of any information obtained from the App is at your own risk.

Disclaimer of Warranties

Huzz AI is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, regarding the App and its Content. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.We do not guarantee that:

The App will be uninterrupted, secure, or error-free at all times.
The information or results obtained through the App will be accurate or meet your expectations.
Any defects or errors in the App will be corrected.

No advice or information, whether oral or written, obtained by you from us or through the App shall create any warranty not expressly stated in these Terms. You assume all risk for any damage to your device or loss of data that results from using the App.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Huzz AI or its creators, owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of (or inability to access or use) the App;
Any conduct or content of any third party relating to the App;
Any content obtained from the App, including any reliance on or decisions made based on AI-generated responses;
Unauthorized access, use, or alteration of your transmissions or content.

In no case shall our aggregate liability for all claims relating to the App exceed the total amount you paid us (if any) for the use of the App in the past six (6) months. If you have not made any payments to us, we shall have no liability to you, to the extent permitted by law.

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Huzz AI, its owners, developers, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

Your breach of these Terms: Any violation of these Terms by you.
Misuse of the App: Your use of the App or Content in a manner not permitted by these Terms, including any illegal, fraudulent, or negligent use.
Violation of Law or Rights of Others: Your violation of any applicable law or regulation, or your infringement of any rights of a third party.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate with our defense of those claims.

Changes to These Terms

We may update or modify these Terms from time to time. If we make material changes, we will notify you by updating the "Effective Date" at the top of this document and, if feasible, through an in-app notification or email. It is your responsibility to review these Terms periodically for any changes. Your continued use of Huzz AI after any modifications to the Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the App.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of South Australia, Australia, without regard to its conflict of law principles. You agree that any dispute or claim arising out of or relating to these Terms or your use of the App will be brought exclusively in the courts located in Adelaide, South Australia, and you hereby consent to the personal jurisdiction and venue of such courts.

If you reside in a jurisdiction that requires different consumer protection or dispute resolution provisions, those required provisions will apply to you to the extent necessary. In any event, nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of local law.

Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Huzz AI, and supersede any prior agreements or understandings (whether oral or written) relating to the same subject matter.
